Payout for Libby asbestos victims begins

LIBBY, Montana – Over 200 asbestos victims have received their portion of a $43 million settlement after becoming ill due to asbestos exposure from the former W.R. Grace & Co. vermiculite mine at Libby.

The settlement, which was approved in September 2011 by District Court in Helena, names a total of 1,128 asbestos victims. A resolution for another 600 claimants is close, but unfortunately, hundreds of other victims will have to wait until they can obtain a release from Medicare liens.

In cases where private insurance companies or the Grace Libby Medical Plan paid victims, no lien was placed. However, those with Medicare have to wait until they can obtain the green light to claim their settlement.

“Where Medicare has paid, it has a right by statute to recoup what it paid from settlements obtained by Libby asbestos disease patients,” said Jon Heberling, a Kalispell attorney and joint counsel for Libby claimant. “Since September when the state of Montana settlement was approved by the court, counsel for the Libby asbestos disease patients have worked closely with Medicare officials to fast track release of the Medicare liens.”

It is likely that the remaining claimants will be evaluated individually, but luckily, Medicare has agreed to an expedited review process.

Judge approves $43 million settlement for asbestos victims in Libby, Montana

A Montana state judge has approved a $43 million settlement for over a thousand asbestos victims, who claimed the state failed to warn them of dangers of a nearby vermiculite mine.

Judge Jeffery Sherlock approved the deal on Sept. 8th. Sherlock dismissed the victim’s claims nine years earlier, which was overturned by the Supreme Court. Libby, Montana was once covered in asbestos dust that came from the W.R. Grace mine. Close to 400 people have died and over 1,700 have been sickened by the asbestos which blanketed the town at one point.

New plant in Libby to help community economy

LIBBY, Montana – The Montana Community Development Corporation has announced that Stinger Welding will get $17 million for the completion of its new fabrication plant in Libby.

The plant will lead to 100 new jobs and create income for the town, which has been struggling with underemployment for the past few months and which is still struggling with the aftermath of asbestos disease from the former W.R. Grace & Co. vermiculite mine.

The construction of the new plant began in 2009, but was delayed  due to a lack of financing. the facility was able to obtain it’s needed aid from a federal financing program written by U.S. Sen. Max Baucus, D-Montana hat helps to improve the state’s business opportunities.

Baucus, along with the Montana Community Development Corporation, Stinger Welding and the Urban Investment Group at Goldman Sachs helped play a role in completing the plant.

“It’s very exciting to see them building and going forward,” said Lincoln County Commissioner Tony Berget. “We’ve been able to buy a few bridges from them, and get them at very competitive pricing.”

The plant, which is 105,000-square-feet, will provide steel for bridge infrastructure projects in the Northwest region.

The fabrication plant is expected to be completed by August with production beginning in the fall.

Scientists have discovered possible treatment for suppression of mesothelioma cells

DETROIT, Michigan – Scientists from the Karmanos Cancer Institute in Detroit, Michigan have completed studies of in vitro and in vivo effects of curcumin on mesothelioma, a cancer associated with the exposure of asbestos which affects the lining of the body’s major organs and cavities.

 

Curcumin is a derivative of turmeric that has been used to induce programmed cell death known as apoptosis. Its effects were studied when used in conjunction with chemotherapy to treat mesothelioma patients.

The scientists found that mesothelioma cells in laboratory mice and humans can be suppressed when exposed to curcumin. The levels of the suppression of cell growth were directly related to the dose of orally administered curcumin. The scientists also found that pre-treating malignant mesothelioma cells with curcumin rendered them more responsive to cisplatin chemotherapy. The treatment was found to elevate apoptosis-inducing proteins, making cells more susceptible to treatment.

The Karmanos Cancer Institute partnered with Wayne State University’s Center for Occupational and Environmental Medicine for the study to form the National Center for Vermiculite and Asbestos-Related Cancers.

The research marks a significant breakthrough in the fight for mesothelioma cancer, for which there is currently no cure.
