Libby asbestos victims to be compensated

MONTANA – Asbestos victims in Libby, Montana are finally getting the justice they deserve. A $19.5 million settlement has been proposed for asbestos victims involved in the W.R. Grace and Co. bankruptcy case.

The settlement will be used to fund the Libby Medical Program, benefitting those who have developed illnesses from exposure to asbestos at the company’s former vermiculite plant.

W.R. Grace created the Libby Medical Program in 2000, following reports that several people became sick or died after being exposed to asbestos.
Asbestos is a mineral found in nature that was once widely used in construction. Once it was discovered that asbestos contributes to several illnesses, including the deadly mesothelioma cancer, it was banned in the United States.

Mesothelioma is a rare cancer that affects the lungs, heart and chest. It is extremely difficult to both diagnose and treat because it can take decades to manifest. Symptoms aren’t always alarming and by the time victims seek help, it is usually too late.

Although there are treatments for mesothelioma, including chemotherapy, radiation and surgery, sadly, there is no cure for the cancer.

According to Jon Heberling, the attorney representing the asbestos victims, the proposed settlement ensures that the company will not be able terminate the medical program, which it was previously able to do at any moment.

In addition, Heberling says claimants also will be eligible to receive settlements from the separate Asbestos Personal Injury Trust that will be established as part of W.R. Grace’s bankruptcy reorganization plan.

Vancouver employer sentenced to 60 days in jail after exposing workers to asbestos

A Metro Vancouver employer has been sentenced to 60 days in jail after exposing his workers to asbestos.

Arthur Moore was sentenced in B.C. Supreme Court Tuesday after ignoring court orders that he stop demolition work after failing to provide protective gear for his workers while they handled asbestos.

“Thankfully, at least one time in all the time I’ve been in this province, an employer is going to jail for basically giving the death sentence to a whole lot of workers,” said B.C. Federation of Labour president Jim Sinclair.

However, Sinclair believes the punishment was too light.

“The system is still fundamentally broken,” Sinclair said. “[Moore] should have been charged with criminal neglect as soon as he did it.”

Moore would repeatedly expose his workers to asbestos knowingly, often hiring recovering addicts as young as 14 years of age. He would run his business under several names, including AM Environmental, Tri City Hazmat, Surrey Hazmat, Pro Scan Environmental and others.

“This is going to be a pretty rare opportunity to see an employer that does this type of stuff actually go to jail for what he is doing,” said Lee Loftus, spokesman for the B.C. and Yukon Building and Construction Trades Council.

New Study Shows Common Cold May Help Fight Mesothelioma

A new study shows that mesothelioma cancer may be fought by an unlikely source – the common cold.

Researchers at the Perelman School of Medicine at the University of Pennsylvania performed a clinical trial using a modified cold virus to see how it would react with mesothelioma tumors. Nine mesothelioma patients were injected with the adenovirus, a modified version of the common cold, and the virus began attacking the tumors.

Mesothelioma is a deadly cancer, linked to the exposure of asbestos. It is very rare and very difficult to both diagnose and treat. Mesothelioma affects the lining of the lungs, heart and chest, but symptoms may not develop for up to 50 years after initial asbestos exposure. Although there are treatments for it, such as chemotherapy, radiation and surgery, there is currently no cure.

The scientists altered the cold virus to contain high levels of interferon-alpha, an immune system stimulant that helps the body fight off viral infections and some cancers. All nine patients had varying degrees of the cancer and after being treated, some showed signs that their immune systems continued to fight the tumors.

Of the nine who were treated, five experienced tumor regression or stability. However, those with more advanced mesothelioma did not respond.
The study’s author, Dr. Steven M. Albelda, said the treatment may help patients in the early stages of the disease.

Massachusetts high school spends millions on asbestos abatement

A Massachusetts high school is finding that a remodeling project is going to cost a lot more than expected. The project has already exceeded $190 million, with a significant portion of that cost stemming from asbestos abatement.

Newton North High School, located just outside of Boston, is known for being the expensive high school ever built in Massachusetts. The school system spent nearly $14 million for the building’s demolition because of costs involving asbestos removal.

Newton officials discovered the asbestos problem in 2010. The original budget to demolish the school was $7.2 million but the costs nearly doubled once asbestos was found in the building’s exterior walls.

Careful work had to be done to ensure that no asbestos fibers were released into the air. Once asbestos fibers become airborne, they can be breathed in by victims, leading to several diseases like mesothelioma.

Asbestos Abatement Project for National Guard Armory to Begin in January

MORGANTOWN, West Virginia — An abatement project to remove asbestos that was discovered in the West Virginia Army National Guard Armory in Morgantown is expected to begin at the end of January.

According to Lt. Col. David Shafer, the abatement project, which will cost about $29,500, will be done by a contractor. Lt. Col. Shafer explains the asbestos isn’t friable, meaning that it cannot be released into the air and will not pose a health risk to those around it.

The danger behind asbestos fibers stems from the fact that once airborne, they can be breathed in by unsuspecting victims, leading to several diseases such as mesothelioma.

Mesothelioma is a rare cancer that affects the lining of the lung, heart and chest cavities. Approximately 3,000 new cases are discovered yearly in the United States ,but many more go unnoticed because it can take up to 50 years for the cancer to develop and symptoms may be so mild that the victim will not seek medical attention.

Although there are treatments that may help prolong the lives of mesothelioma victims, such as chemotherapy, radiation and surgery, sadly, there is currently no cure for the terrible illness.

Meanwhile, The National Guard has made plans to move to a new $20.5 million readiness center by the summer of 2013. The ownership of the existing armory will be transferred to the city of Morgantown.
