Conoco Phillips Corp. appeals asbestos settlement decision

JACKSON — Conoco Phillips Corp. has appealed a jury decision that granted a multi-million dollar settlement to an oil drilling worker who claimed he became ill following asbestos exposure.

The Mississippi Supreme Court will hear Conoco’s arguments on Monday. The company has appealed a jury decision granting $15.2 million to a victim who claimed to have developed asbestosis as a result of working around asbestos.

The victim, Troy Lofton, filed the claims against CP Chem, a division of Conoco Phillips. He was diagnosed with asbestosis in 2004.

Lofton claimed that CP Chem knowingly shipped asbestos-laden products for 20 years that were used in the oil and gas well drilling industry in which he worked. As a result of the exposure to asbestos, Lofton now has to remain on oxygen 24 hours a day.

Conoco denies the claims and has filed an appeal. Arguments are scheduled for 1:30 p.m. in Jackson.

Asbestos victim awarded over $300 million in damages

MISSISSIPPI – A Mississippi asbestos victim has been awarded $322 million for asbestos claims brought against his former employers.


Thomas “Tony” Brown, Jr. sued Chevron Phillips Chemical Co. and Union Carbide Corp. over having been exposed to the harmful mineral at work.


According to Brown’s lawyer, he worked in oil fields from the late 1970s to the mid 1980s and was responsible for mixing drilling muds. In the asbestos claim, Brown alleges that while at work, he was exposed to asbestos dust.


As a result, Brown, now 48, developed asbestosis, which he was diagnosed with at the age of 30.


Asbestosis is caused by breathing in asbestos fibers that become airborne when the mineral is disturbed. It affects the tissues of the lungs and can cause scarring and shortness of breath.


Since developing asbestosis, Brown needs to be on oxygen 24 hours a day.


The award is believed to be the largest single plaintiff asbestos verdict in U.S. history.


Both of the defending companies have said they plan to appeal the verdict to the Mississippi Supreme Court.


“The credible medical evidence introduced at trial clearly demonstrates that, while Mr. Brown suffers from shortness of breath, such condition is not attributable to asbestos exposure,” read a statement from Union Carbide.


According to Brown’s lawyers, their client was illiterate when he entered the asbestos industry at the age of 16, and was not able to read asbestos warnings, which the companies are using in their defense.


However, this fact did not sway jurors in favor of the companies.


“The jury’s verdict made it clear that the people of Mississippi think that everyone, including the young men entering the work force that can’t read, deserve equal protection under Mississippi law,” said one of Brown’s asbestos lawyers.
