Developer pleads guilty to improper handling of asbestos

KANSAS CITY – A developer has pleaded guilty to violating the federal Clean Air Act.

William M. Threatt Jr., 71, admitted he improperly removed and disposed of asbestos between 2001 and 2006 while overseeing the development of the Citadel Plaza.

Threatt, the former president of the Community Development Corporation of Kansas City, and Anthony Crompton, the corporation’s former real estate director, were charged in 2010 with failing to properly inspect for asbestos inside buildings that were scheduled to be demolished as well as failing to remove a large portion of the asbestos.

Crompton pleaded guilty in October and Threatt pleaded guilty on Wednesday.

A sentencing date has yet to be set for either Threatt or Crompton, but both are facing up to five years in prison and a maximum $250,000 fine.

Payout for Libby asbestos victims begins

LIBBY, Montana – Over 200 asbestos victims have received their portion of a $43 million settlement after becoming ill due to asbestos exposure from the former W.R. Grace & Co. vermiculite mine at Libby.

The settlement, which was approved in September 2011 by District Court in Helena, names a total of 1,128 asbestos victims. A resolution for another 600 claimants is close, but unfortunately, hundreds of other victims will have to wait until they can obtain a release from Medicare liens.

In cases where private insurance companies or the Grace Libby Medical Plan paid victims, no lien was placed. However, those with Medicare have to wait until they can obtain the green light to claim their settlement.

“Where Medicare has paid, it has a right by statute to recoup what it paid from settlements obtained by Libby asbestos disease patients,” said Jon Heberling, a Kalispell attorney and joint counsel for Libby claimant. “Since September when the state of Montana settlement was approved by the court, counsel for the Libby asbestos disease patients have worked closely with Medicare officials to fast track release of the Medicare liens.”

Two indicted in Asbestos Case

Two men have been indicted in an asbestos removal case. One is a property owner from Weston and the other is a heating contractor from Plainville.

The men were indicted by a Norfolk County grand jury for their role in improperly removing asbestos from a single-family rental property in Medway. David Einis, 58, of Weston, and Nicholas Pasquantonio, 41, of Plainville, were indicted on two counts of violating the Massachusetts Clean Air Act, failure to file a notice of asbestos removal with the Massachusetts Department of Environmental Protection and failure to prevent asbestos emissions, said Attorney General Martha Coakley in a statement.

The charges are in response to an asbestos abatement procedure from December 2010. Einis hired Pasquantonio, of Johnny’s Oil Service Inc., to replace the boiler in the property that is home to a family with children. Pasquantonio is not a licensed asbestos contractor.

Pasquantonio did not seal off the basement while he was replacing the boiler and when MassDEP inspected the site, it was discovered that Pasquantonio allowed asbestos to become loose and airborne.
