Threatt, the former president of the Community Development Corporation of Kansas City, and Anthony Crompton, the corporation’s former real estate director, were charged in 2010 with failing to properly inspect for asbestos inside buildings that were scheduled to be demolished as well as failing to remove a large portion of the asbestos.

A sentencing date has yet to be set for either Threatt or Crompton, but both are facing up to five years in prison and a maximum $250,000 fine.
Asbestos is a mineral found in nature that was previously used in the United States due to its insulating capabilities, durability and strength. However, once it was discovered that asbestos caused several health issues, it was banned in the country. Unfortunately, many people continue to use it or improperly handle it, placing several lives at risk.

Mesothelioma can take up to 50 years to develop, making it extremely difficult to both diagnose and treat. Unfortunately, despite advances in modern medicine, there is currently no cure for mesothelioma.

Payout for Libby asbestos victims begins

LIBBY, Montana – Over 200 asbestos victims have received their portion of a $43 million settlement after becoming ill due to asbestos exposure from the former W.R. Grace & Co. vermiculite mine at Libby.

The settlement, which was approved in September 2011 by District Court in Helena, names a total of 1,128 asbestos victims. A resolution for another 600 claimants is close, but unfortunately, hundreds of other victims will have to wait until they can obtain a release from Medicare liens.

In cases where private insurance companies or the Grace Libby Medical Plan paid victims, no lien was placed. However, those with Medicare have to wait until they can obtain the green light to claim their settlement.

“Where Medicare has paid, it has a right by statute to recoup what it paid from settlements obtained by Libby asbestos disease patients,” said Jon Heberling, a Kalispell attorney and joint counsel for Libby claimant. “Since September when the state of Montana settlement was approved by the court, counsel for the Libby asbestos disease patients have worked closely with Medicare officials to fast track release of the Medicare liens.”

It is likely that the remaining claimants will be evaluated individually, but luckily, Medicare has agreed to an expedited review process.

Asbestos exposure can lead to several illnesses, including mesothelioma cancer, a deadly disease that affects the lungs, heart and chest cavity. California Man Awarded $7.5 Million in Mesothelioma Settlement

LOS ANGELES, CA – A former Chico construction worker was compensated after developing mesothelioma from asbestos exposure.

Represented by mesothelioma attorneys Weitz & Luxenberg, the worker was able to collect $7.5 million after being exposed to asbestos-cement pipe for years.

Six companies were named in the lawsuit and each was found to have contributed to the worker’s illness. The 57-year-old man, who wishes to remain anonymous, was diagnosed with mesothelioma less than a year ago.

Mesothelioma is a rare cancer linked to the exposure of asbestos that affects the lungs, heart and chest cavities. It can take years to develop, making it extremely difficult to both diagnose and treat. Although current medical treatments like chemotherapy, radiation and surgery are available to help patients, there is currently no cure for mesothelioma.

According to Weitz & Luxenberg mesothelioma lawyer Daniel Wasserberg, Esq., “Our client was a construction worker who, in the 1970s and 1980s, helped install underground water and sewer lines. These pipes — 6 to 48 inches in diameter — were made of a concrete-asbestos composite material for strength but also for ease of fabrication. The defendants made, sold or delivered them.”

The plaintiff was responsible for cutting asbestos pipes, and was exposed to asbestos fibers which eventually caused his mesothelioma.

“Our client performed his work with a gasoline-operated saw,” said Brent Zadorozny, Esq., a Weitz & Luxenberg mesothelioma attorney. “The cuts generated an enormous amount of cement-asbestos dust, which flew in every direction from the saw’s whirring blades and engine exhaust blast. This veritable snowstorm of asbestos dust was at times so thick you couldn’t see the person standing three feet away from you.”

After years of being covered in asbestos dust, the plaintiff eventually developed mesothelioma.

Vancouver employer sentenced to 60 days in jail after exposing workers to asbestos

A Metro Vancouver employer has been sentenced to 60 days in jail after exposing his workers to asbestos.

Arthur Moore was sentenced in B.C. Supreme Court Tuesday after ignoring court orders that he stop demolition work after failing to provide protective gear for his workers while they handled asbestos.

“Thankfully, at least one time in all the time I’ve been in this province, an employer is going to jail for basically giving the death sentence to a whole lot of workers,” said B.C. Federation of Labour president Jim Sinclair.

However, Sinclair believes the punishment was too light.

“The system is still fundamentally broken,” Sinclair said. “[Moore] should have been charged with criminal neglect as soon as he did it.”

Moore would repeatedly expose his workers to asbestos knowingly, often hiring recovering addicts as young as 14 years of age. He would run his business under several names, including AM Environmental, Tri City Hazmat, Surrey Hazmat, Pro Scan Environmental and others.

“This is going to be a pretty rare opportunity to see an employer that does this type of stuff actually go to jail for what he is doing,” said Lee Loftus, spokesman for the B.C. and Yukon Building and Construction Trades Council.
