Conoco Phillips Corp. appeals asbestos settlement decision

JACKSON — Conoco Phillips Corp. has appealed a jury decision that granted a multi-million dollar settlement to an oil drilling worker who claimed he became ill following asbestos exposure.

The Mississippi Supreme Court will hear Conoco’s arguments on Monday. The company has appealed a jury decision granting $15.2 million to a victim who claimed to have developed asbestosis as a result of working around asbestos.

The victim, Troy Lofton, filed the claims against CP Chem, a division of Conoco Phillips. He was diagnosed with asbestosis in 2004.

Lofton claimed that CP Chem knowingly shipped asbestos-laden products for 20 years that were used in the oil and gas well drilling industry in which he worked. As a result of the exposure to asbestos, Lofton now has to remain on oxygen 24 hours a day.

Conoco denies the claims and has filed an appeal. Arguments are scheduled for 1:30 p.m. in Jackson.
Asbestos is a mineral found in nature. It was once popularly used in construction materials due to its strength and durability. However, once it was discovered that asbestos contributed to several diseases, like asbestosis and mesothelioma, it was banned in the United States.

However, some companies continue to use asbestos illegally, exposing workers to the hazardous mineral and threatening their lives. Mesothelioma is perhaps the worst of all asbestos-related diseases because it is very hard to diagnose and treat.

Mesothelioma, a rare cancer that affects the lungs, heart and chest, can take up to 50 years to develop and its symptoms are often so mild that victims never end up seeking medical care. Even though some treatments might help patients who catch the cancer early on, there is currently no cure for mesothelioma.

If you are struggling with mesothelioma or have had a loved one pass away from the disease, you have a right to seek legal help. Turn to a leading mesothelioma lawyer immediately for assistance in filing a claim. As an asbestos victim, you may be entitled to millions of dollars in compensation, and mesothelioma attorneys ensure you receive every penny.

South Florida couple awarded multimillion dollar settlement in asbestos case

MIAMI, Florida – A South Florida mesothelioma victim and his wife were awarded a multimillion dollar settlement in an asbestos litigation case. A Broward County jury awarded $20,646,000 to Plaintiff Charles Garrison and his wife, Cynthia last Friday in a Broward County courtroom.

Charles Garrison, 61, was diagnosed with mesothelioma in 2008. His mesothelioma lawyer, Juan Bauta, of The Ferraro Law Firm in Miami, argued in his defense against Union Carbide Corp., claiming that Garrison was exposed to Georgia Pacific’s joint compound which contained Union Carbide asbestos from 1974 to 1975, and this lead to the development of his cancer.

Mesothelioma is a very rare type of cancer, but a very difficult one to both diagnose and treat. It develops after a victim is exposed to asbestos fibers, which are airborne and can be inhaled, lodging in the victim’s lungs. The cancer can actually affect the lungs, chest and abdomen, but symptoms do not always manifest. If they do, they are usually so mild that the victim does not seek medical attention.

Although there are some treatments for mesothelioma available, such as chemotherapy, surgery and radiation, there is still no cure for the terminal cancer. Approximately 3,500 new mesothelioma cases are diagnosed each year in the United States alone, but unfortunately, many more go unnoticed. By the time that most victims get help, it is usually too late. There is but a small 12-18 month period when a mesothelioma victim can hope for success with treatment.

“It is remarkable to me that Union Carbide did not attempt to try to settle this case rather than put the Garrison’s through more than two weeks of intense trial,” argued Juan Bauta. If you or a loved one are suffering with mesothelioma, chances are you were exposed at work. Many corporations do not take sufficient precaution against protecting their employees from exposure to the hazardous mineral. Sometimes, employers don’t even tell their workers that asbestos is present at a site, leading them to inhale the mineral’s fibers on a constant basis and bringing asbestos-laden clothes home, which may lead family members to become ill as well.
