Payout for Libby asbestos victims begins

LIBBY, Montana – Over 200 asbestos victims have received their portion of a $43 million settlement after becoming ill due to asbestos exposure from the former W.R. Grace & Co. vermiculite mine at Libby.

The settlement, which was approved in September 2011 by District Court in Helena, names a total of 1,128 asbestos victims. A resolution for another 600 claimants is close, but unfortunately, hundreds of other victims will have to wait until they can obtain a release from Medicare liens.

In cases where private insurance companies or the Grace Libby Medical Plan paid victims, no lien was placed. However, those with Medicare have to wait until they can obtain the green light to claim their settlement.

“Where Medicare has paid, it has a right by statute to recoup what it paid from settlements obtained by Libby asbestos disease patients,” said Jon Heberling, a Kalispell attorney and joint counsel for Libby claimant. “Since September when the state of Montana settlement was approved by the court, counsel for the Libby asbestos disease patients have worked closely with Medicare officials to fast track release of the Medicare liens.”

It is likely that the remaining claimants will be evaluated individually, but luckily, Medicare has agreed to an expedited review process.

Asbestos Abatement Procedure Complete at Ohio Site

Piketon, Ohio – The asbestos abatement procedure for the X-333 Process Building at the Department of Energy’s (DOE) Portsmouth Site has been completed, giving demolishers the ok to tear down the former gaseous diffusion plant.

The abatement process has been going on since November and is part of the DOE’s decontamination process for all sites that are to be demolished. The Portsmouth Site has been around since 1954, when asbestos was legally used in the United States.

University of Hawaii Receives Multi-million Dollar Research Grant from the National Cancer Institute

HAWAII – The University of Hawaii Cancer Center has received $4.3 million in grants from the National Cancer Institute for research on different types of cancers, including mesothelioma.

Haining Yang received a five-year grant for $1.5 million to study the correlation between asbestos exposure and malignant mesothelioma in order to help scientists develop better treatment and prevention methods for the deadly disease. Mesothelioma Cancer Alliance raises funds for research through Twitter

Syracuse, New York – The Mesothelioma Cancer Alliance has launched an international campaign to raise funding for mesothelioma research and the support of organizations through Twitter.

Under the Twitter name @CancerAlliance, the organization has pledged to donate $1 for every new Twitter follower they gain between now and September 2nd, 2011 up to $50,000.

The Alliance is also encouraging their followers to vote on which cancer research or support group will receive the funds. New followers can either choose from one of several national organizations or nominate one.

“It’s our way of letting members of our Twitter community have a voice in who receives the funding,” said Jack Bleeker, spokesman for the fundraising effort.

Through the use of social media, the organization hopes to encourage the support of those in the community and increase awareness of mesothelioma.

“Some of these organizations aren’t as well known as LIVESTRONG or other nationally recognized members of the cancer community, but they all deserve their chance at the funding. We’re trying to mobilize lesser-known organizations and their constituencies to get the word out,” added Bleeker.

RPM International Inc. to fund asbestos trust

A lawyer for RPM International Inc., the maker of Rust-Oleum paint, told a bankruptcy judge on March 28 that the company would contribute to the funding of a trust for asbestos victims.

 

RPM was hit with over 10,000 asbestos lawsuits that have been on hold since two of the company’s subsidiaries – Specialty Products Holding Corp. and Bondex International Incl. – filed for bankruptcy protection in May 2010.

 

Asbestos was discovered in a number of Bondex products sold between 1966 and 1977, leading numerous victims to develop deadly disease, including mesothelioma, a rare and incurable cancer that attacks the lining of the lungs, heart and chest cavities.

 

Specialty was the holding company that owned Bondex as well as several other manufacturers of coatings and chemicals. Approximately 15,000 asbestos and mesothelioma lawsuits were filed against Specialty.

 

When Specialty and Bondex filed for bankruptcy, they did not discuss how they would fund an asbestos trust. However, since the filing, Specialty has been fighting for access data regarding how much money asbestos victims have received for similar cases. The company said that it hopes to use that data to calculate how much they should invest into the asbestos trust for their own settlements.
