Conoco Phillips Corp. appeals asbestos settlement decision

JACKSON — Conoco Phillips Corp. has appealed a jury decision that granted a multi-million dollar settlement to an oil drilling worker who claimed he became ill following asbestos exposure.

The Mississippi Supreme Court will hear Conoco’s arguments on Monday. The company has appealed a jury decision granting $15.2 million to a victim who claimed to have developed asbestosis as a result of working around asbestos.

The victim, Troy Lofton, filed the claims against CP Chem, a division of Conoco Phillips. He was diagnosed with asbestosis in 2004.

Lofton claimed that CP Chem knowingly shipped asbestos-laden products for 20 years that were used in the oil and gas well drilling industry in which he worked. As a result of the exposure to asbestos, Lofton now has to remain on oxygen 24 hours a day.

Conoco denies the claims and has filed an appeal. Arguments are scheduled for 1:30 p.m. in Jackson.
Asbestos is a mineral found in nature. It was once popularly used in construction materials due to its strength and durability. However, once it was discovered that asbestos contributed to several diseases, like asbestosis and mesothelioma, it was banned in the United States.

However, some companies continue to use asbestos illegally, exposing workers to the hazardous mineral and threatening their lives. Mesothelioma is perhaps the worst of all asbestos-related diseases because it is very hard to diagnose and treat.

Mesothelioma, a rare cancer that affects the lungs, heart and chest, can take up to 50 years to develop and its symptoms are often so mild that victims never end up seeking medical care. Even though some treatments might help patients who catch the cancer early on, there is currently no cure for mesothelioma.

If you are struggling with mesothelioma or have had a loved one pass away from the disease, you have a right to seek legal help. Turn to a leading mesothelioma lawyer immediately for assistance in filing a claim. As an asbestos victim, you may be entitled to millions of dollars in compensation, and mesothelioma attorneys ensure you receive every penny.

Researchers discover link between asbestos exposure and mortality rate among textile workers

New research shows that textile workers in North Carolina and South Carolina who have been exposed to asbestos had a significantly greater rate of lung cancer, including mesothelioma.

Asbestos is a mineral that was once popularly used in construction materials and textiles but has been banned from several countries, including the United States, because it contributes to a number of illnesses, like the deadly mesothelioma.

Mesothelioma is a cancer that affects the lungs, heart and lining of the chest. It can take up to 50 years to develop, making it extremely difficult to both diagnose and treat. Although the cancer can be fought with chemotherapy, radiation and surgery, there is still no cure for mesothelioma.

In a study published in the January issue of the Occupational and Environmental Medicine journal, researchers monitored the progress of over 6,100 textile workers at four Carolina textile mills that previously manufactured asbestos. The researchers reported elevated death rates from lung cancer among the workers as opposed to the general population.

The researchers, based at the University of Nebraska, Duke University and the University of North Carolina, found that there was a strong correlation between the increased mortality rate from lung cancer and the exposure of asbestos.

The research further shows the dangers of breathing in asbestos fibers.

Company Accused of Contributing to Mesothelioma Patient’s Illness Appeals Ruling

A company that was blamed for their role in exposing a mesothelioma victim to asbestos has decided to appeal the court’s ruling.

Simon Lowes was awarded $2.07 million last month in damages after contracting mesothelioma from playing in asbestos materials as a child. The company that was to blame for his disease, James Hardie, has decided to appeal this ruling, which Lowes admits to being “very disappointed” in.

Lowes, 42, developed mesothelioma after playing in asbestos waste that was dumped by James Hardie at the Castledare miniature railway site in Wilson in the 1970s. Back then, asbestos was legal in the U.S. and popularly used in construction materials.

The mineral is now currently banned after it was discovered that breathing in asbestos fibers can contribute to several illnesses, including mesothelioma. Mesothelioma is a form of cancer that affects the lining of the lungs, heart and chest cavities. It can take up to 50 years to manifest, so most victims never become aware of their illness until it is too late. Although there are several treatments for mesothelioma, including chemotherapy, radiation and surgery, there is currently no cure for the disease.

Lowes’ mesothelioma attorneys, Slater & Gordon, confirmed today that a subsidiary of James Hardie, Amaca, filed for an appeal of the ruling.

“Simon is very disappointed that James Hardie’s compensation fund (Amaca) has not accepted the umpire’s decision and instead are going to spend more time and money trying to avoid responsibility for his life-threatening cancer,” said Michael Magazanik, a mesothelioma lawyer for Lowes. “He hopes that the people in charge at the fund reconsider their position and accept that exposing him to a deadly toxin when he was a three-year-old was outrageous and that the judgment sum should be paid and everybody left to get on with their lives.”

Mesothelioma victim speaks out on how disease changed his life and how he plans to raise awareness

David Phillips was diagnosed with mesothelioma four years ago, but at that time, he did not know what caused it. As a travel agent for 40 years, the 64-year-old had never thought he had been exposed to any of the types of construction materials associated with asbestos contamination, except for one time, while in the London office of his former company in the late 70s. Phillips remembers cleaning out a storage cupboard and being covered in dust.

Since it can take decades for mesothelioma to develop, the disease was dormant until a few years after taking early retirement. The first sign that told Phillips something was wrong was that he suffered a panic attack and was not able to breathe. “We went out for a meal with some friends, I had a panic attack. They bundled me into a car and took me to Hinchingbrooke Hospital,” recounted Phillips. “One of the first questions I was asked was ‘Had I ever worked with asbestos?” At first, Phillips was diagnosed with pleuresy, but six weeks later, he became sick again, and after several more tests, doctors discovered fluid in his lungs. Now, after several rounds of chemotherapy, radiotherapy and an operation to stop the progression of the cancer, Phillips has been told nothing more can be done to help him.

“There is no cure for the disease at all. They tried to remove as much of the tumour as possible and for three years it worked,” said Phillips. “About a year ago, I knew something was not right. The doctor told me it had returned but now it has spread from the left to the right lung.”
Phillips went on to say how mesothelioma has changed his life for the worst.

“I can’t walk long distances. I can’t do gardening – what normally took me a day to do, now takes me a week and a half. It is little things like mowing the lawn, I can’t do now,” he explained. “But I have got away with four years. Initially they gave me 12 to 15 months, so I am pretty happy with what I have got.” Now, Phillips is determined to raise awareness of mesothelioma and the dangers of being exposed to asbestos. Last year he jumped 1,400 feet from a plane to raise money for Mesothelioma UK and this year, his daughter, Laura, completed the Run to the Beat half marathon in London for the same charity. “I want to see more action. There is a lot of money that goes into breast cancer care, but mesothelioma gets hardly any funding whatsoever,” said Phillips.

President Obama stresses importance of handling asbestos in public schools

President Obama has proposed to do something about the asbestos problem many public schools are facing. The proposal is included in the “American Jobs Act,” a bill that is intended to stimulate job creation in the United States as well as improving the standard of living.

The plan, costing $447 billion, would allocate a portion of the funds to go toward identifying and removing asbestos-laden materials in public schools.
The new bill would contribute to the renovation of roughly 35,000 public schools. Seeing as how asbestos abatement can take time and become very costly, the procedure is not expected to be an overnight fix to a longstanding problem.

Asbestos is a mineral found in nature that was once popularly used in construction materials due to its strength and durability. However, once the hazards of being exposed to asbestos were discovered, the mineral was banned in the U.S. in the late 1980s. Yet, there are still a number of older buildings and structures that contain asbestos, including several public schools.

When intact, asbestos doesn’t pose much of a threat, but breathing in asbestos fibers can contribute to a number of illnesses, including mesothelioma, a terminal cancer that affects the lining of the lungs, heart and chest cavity. Although several treatments for mesothelioma, like chemotherapy, radiation and surgery, might help prolong the lives of victims, there is currently no cure for the illness. The most terrible thing about mesothelioma is that the vast majority of victims are not even aware that they are ill. It can take up to 50 years for the cancer to develop and by the time symptoms manifest, it is usually too late.

Mesothelioma symptoms can also be very mild, not causing much alarm to the victims to lead them to seek medical care. And to top it off, there is only a small window period to seek treatment successfully, which is only about 12-18 months.

However, there is still a way for mesothelioma patients to seek help for their cancer and to obtain justice after having been exposed to asbestos. If you or someone you love is struggling with this terrible disease, contact a leading mesothelioma lawyer right away. Mesothelioma attorneys work diligently to secure you and your loved ones the compensation and benefits you deserve for having been exposed to asbestos. Usually, those suffering from mesothelioma contracted the illness because of someone’s negligence. Employers are mostly to blame because of a lack of safety requirements or because they don’t properly inform workers of asbestos at a job site. With a leading team of mesothelioma lawyers, you can rest assured that those responsible for your disease will be held accountable. Your paralegal will work non-stop so you can obtain the money damages and medical care you rightfully deserve.
