Payout for Libby asbestos victims begins

Judge overturns multimillion-dollar asbestos verdict

A Mississippi judge has overturned a $322 million verdict in an asbestos case against Dow Chemical Co.’s Union Carbide unit and Chevron Phillips Chemical Co.

The companies appealed the jury decision to the state Supreme Court, arguing Smith County Circuit Judge Eddie Bowen had a conflict of interest because his parents had filed asbestos claims, including one against Union Carbide.

The state’s high court removed Bowen from the case last year. His replacement, Special Judge William F. Coleman, overturned the decision and stated the companies’ request to remove Bowen and contest the verdict were “well taken and should be granted.”

The settlement, which was granted on May 4, 2011, was the largest ever made to a single asbestos case plaintiff and the ninth-largest overall in the U.S. for the year.

Earthquake rubble found free of asbestos

Following concerns after an earthquake, asbestos testing at a Christchurch landfill has not found any evidence of the hazardous mineral. The Department of Labour released a report on Monday under the Official Information Act and explained that Christchurch demolition firm Dormer Construction and the Canterbury Earthquake Recovery Authority (Cera) failed to uncover the presence of asbestos at a Cashel St demolition site back in July.

The department received a complaint alleging that 24 truckloads of asbestos-laded rubble from the earthquake had been dumped at the Burwood recovery park and contaminated steel was taken to Christchurch recycling plant Sims Pacific Metals before the presence of the mineral was even discovered. Department inspector Steve Moran reported that an unnamed individual complained that he was “extremely concerned” that the case was not an isolated incident.

The complainant also told Moran that a digger driver working at the Cashel St site was also concerned about the presence of asbestos. The report said Cera’s assessment found asbestos in the building’s balcony, but the information was not passed on to Dormer Construction. The company had already had an opportunity to test for asbestos before the materials were removed. A Cera spokeswoman said a “small amount” of asbestos was found during a building demolition after the June 13 quake. The recovery park brought in an asbestos contractor and the area of potential contamination was contained. Testing could not identify any asbestos. Cera’s spokeswoman said Dormer Construction was “extremely experienced”.

“All contractors and their staff have had training in recognising asbestos” since the incident, she said. Massachusetts school fined for improper asbestos removal

MASSACUSETTS – The Massachusetts Department of Environmental Protection has fined the Medford School Department for failing to dispose of asbestos-laden tiles properly at Curtis Tufts Alternative High School. The incident occurred during the summer of 2009 when, according to Superintendent Roy Belson, the cleaning staff at the school took tiles that were contaminated with asbestos and that had been removed from the school and dumped them in a normal trash can behind the school building.

Once the tiles were discovered, they were moved from Curtis Tufts to the nearby Fulton School. District officials contend that neither students nor teachers were exposed to asbestos, but they can’t make the same assumption that others who handled the infested tiles were not.
