Two indicted in Asbestos Case

Two men have been indicted in an asbestos removal case. One is a property owner from Weston and the other is a heating contractor from Plainville.

The men were indicted by a Norfolk County grand jury for their role in improperly removing asbestos from a single-family rental property in Medway. David Einis, 58, of Weston, and Nicholas Pasquantonio, 41, of Plainville, were indicted on two counts of violating the Massachusetts Clean Air Act, failure to file a notice of asbestos removal with the Massachusetts Department of Environmental Protection and failure to prevent asbestos emissions, said Attorney General Martha Coakley in a statement.

The charges are in response to an asbestos abatement procedure from December 2010. Einis hired Pasquantonio, of Johnny’s Oil Service Inc., to replace the boiler in the property that is home to a family with children. Pasquantonio is not a licensed asbestos contractor.

Pasquantonio did not seal off the basement while he was replacing the boiler and when MassDEP inspected the site, it was discovered that Pasquantonio allowed asbestos to become loose and airborne.

Steve McQueen to be Honored at Asbestos Disease Awareness Organization Convention

Court Overturns Multi-million Dollar Asbestos Verdict

SPRINGFIELD, Illinois – Multimillion dollar asbestos verdict rejected. Just five months after Illinois Fourth District appellate judges reversed a McLean County jury’s verdict against Honeywell International, another panel of the same court has rejected another conspiracy verdict against the company.

On Dec. 23, three judges found that Circuit Judge Scott Drazewski should have rejected a jury’s $5.5 million award to three widows.

“The record contains no evidence defendant entered into an agreement with any other corporation to falsely assert asbestos was safe or to keep quiet about the dangers of asbestos, although the record contains evidence defendant, on its own, did those things,” wrote Justice James Knecht.”The evidence must be clear and convincing if a conspiracy is to be proved solely by circumstantial evidence.”

Justice Thomas Appleton and Justice Robert Steigmann also concurred.

The widows, whose husbands worked at Unarco asbestos plant in Bloomington, had all won their separate settlements years ago. Honeywell then secured new trials and Drazewski consolidated the three cases into a single trial in 2009.

Jurors awarded $2,401,000 to Doris Dukes as widow of Merlon Dukes, $1,860,000 to Ruth Watkins as widow of John Watkins, and $1,303,000 to Judy Blessing as widow of Robert Blessing.

Japanese researchers discover way to distinguish between mesothelioma and lung cancer

Mesothelioma, a rare cancer related to the exposure asbestos, is one of the most difficult diseases to both diagnose and treat. However, scientists are now saying that the buildup of fluid in the chest of patients can help distinguish mesothelioma from lung cancer.

Because mesothelioma and lung cancer share similar respiratory symptoms, including fluid buildup, mesothelioma is often misdiagnosed. Now, researchers in Japan have been looking into whether genetic changes in a patient’s pleural fluid can be used to diagnose malignant pleural mesothelioma and distinguish it from lung cancer.

In a December 2011 article published in the journal Cancer Science, the scientists described a new technique of examining the pleural fluid for DNA methylation. DNA methylation is a biochemical process that involves modifying a strand of DNA.

The researchers collected pleural fluid from 39 malignant pleural mesothelioma patients, 46 lung cancer patients, 25 patients with benign asbestos pleurisy and 30 other subjects with varying illnesses. They then examined the pleural fluid in each of the subjects and discovered that the methylation ratios for certain genes were significantly higher for lung cancer patients than for those with mesothelioma, making it a valuable method of distinguishing one cancer from the other.

Roughly 3,500 new cases of mesothelioma are diagnosed yearly in the United States alone. Several others go unnoticed, but that might all change following the researchers’ discovery.
