Conoco Phillips Corp. appeals asbestos settlement decision

JACKSON — Conoco Phillips Corp. has appealed a jury decision that granted a multi-million dollar settlement to an oil drilling worker who claimed he became ill following asbestos exposure.

The Mississippi Supreme Court will hear Conoco’s arguments on Monday. The company has appealed a jury decision granting $15.2 million to a victim who claimed to have developed asbestosis as a result of working around asbestos.

The victim, Troy Lofton, filed the claims against CP Chem, a division of Conoco Phillips. He was diagnosed with asbestosis in 2004.

Lofton claimed that CP Chem knowingly shipped asbestos-laden products for 20 years that were used in the oil and gas well drilling industry in which he worked. As a result of the exposure to asbestos, Lofton now has to remain on oxygen 24 hours a day.

Conoco denies the claims and has filed an appeal. Arguments are scheduled for 1:30 p.m. in Jackson.

Canadian anti-asbestos lobbyists say government was morally wrong in promoting the use and exportation of the mineral

CANADA – Anti-asbestos lobbyists are standing up to the government, claiming that former Canadian politicians, ambassadors and bureaucrats left their morals at the door 20 years ago when they successfully lobbied to prevent the hazardous mineral from being banned in the United States.

Laurie Kazan-Allen of the International Ban Asbestos Secretariat, a group based in Britain, said that, “as a consequence of the legal and political actions mounted by Canadian interest, a further 300,000 tons of Canadian asbestos was used in the United States and vast amounts of asbestos-containing products were incorporated into the United States infrastructure.”

Ms. Kazan-Allen obtained documents from the U.S. Environmental Protection Agency to prove that former Conservative Prime Minister Brian Mulroney lobbied then-U.S. president Ronald Reagan, a friend of his, in the mid-1980s about the EPA’s plan to ban asbestos.

In addition, the documents also claim former Quebec’s premier Robert Bourassa raised Quebec’s concerns about the ban with U.S. trade officials at a meeting in Washington in 1986. Ms. Kazan-Allen said a number of government officials were also pushing the asbestos file in the United States. “While the industry fronted the attack, financial support and political assistance from Quebec and Ottawa underpinned the incursion of Canada’s asbestos foot soldiers into U.S. territory,” said Kazan-Allen.

Michaela Keyserlingk of Canada’s Voices of Asbestos Victims explained that people knew at the time that asbestos was hazardous and led to several diseases, and their actions are inexcusable. “This isn’t how our human affairs should be governed,” she said.  Winnipeg MP Pat Martin shares the sentiment, arguing that promoting the export of asbestos was morally wrong. “It’s the height of hypocrisy that we’re removing all of the asbestos from the Parliament buildings because no MP should be exposed to a single fibre,” said Martin. “But we are dumping as much as 200,000 tons per year into developing and underdeveloped countries where health and safety protocols are minimal or non-existent.” As of now, both Ottawa and the provincial government in Quebec continue to promote the use of asbestos.

Israeli study of mice reveals information on mesothelioma

ISRAEL – Recent studies have shown high rates of mesothelioma cases in Israel, especially in Western Galilee, where there is a large amount of asbestos.

The area has been known to use asbestos widely in flooring, roofing and other construction materials. A large portion of the homes in the area are laden with asbestos, leaving residents to be at risk for exposure to the mineral and to develop diseases like mesothelioma cancer.

In a recent study, Dr. Rachel Ben-Shlomo and Dr. Uri Shanas of University of Haifa, tested the correlation between mutative cancers and the heightened presence of asbestos. A separate study had shown that the population of mice in Western Galilee was also suffering from genetic mutations.

“This study clearly indicates that there is a link between the higher levels of asbestos in the environment and the frequency of genetic somatic mutations in the mammals,” said Dr. Ben-Schlomo and Dr. Shanas.

They surmised that if the mice were at such a high level of risk for genetic mutations, humans would also be in danger from the presence of asbestos.

“These findings teach us that the pollutive, mutagenic asbestos increases somatic mutational frequency, which can in turn heighten the chances of developing cancerous growths.”

Tennessee Supreme Court overrules judgment regarding mesothelioma case

TENNESSEE – A Tennessee Supreme Court Ruling has found that a trial judgment on a mesothelioma case was incorrect.

The Tennessee Supreme court found that the judgment was incorrect for not awarding  compensation to a mesothelioma victim’s family for his death, which was caused by asbestos exposure that a former employer was responsible for.

The victim in question was Hugh Todd Nye, who passed away in 2006 from mesothelioma cancer caused by asbestos exposure while he worked at a DuPont facility. At the facility, he came into contact with products that were laden with asbestos, breathing in the mineral’s fibers.

Mesothelioma is a form of cancer that develops after the asbestos fibers lodge within the lungs of the victim. There is currently no cure for it, although treatments like chemotherapy, radiation and surgery may help to prolong the life of the victim.

During the trial, an intermediary doctrine that protects companies from being held liable for products they are not responsible for was used. As a result, the court found that North Brothers, which is the company that sold the asbestos products, was subject to a liability lawsuit regarding Nye’s mesothelioma cancer, not DuPont.

Because of discrepancies between what the companies were liable for, Nye’s widow ended up receiving no compensation for the death of her husband.

However, the Tennessee Court of Appeals and Supreme Court stepped in and both ruled that the intermediary doctrine was not properly invoked and thus, was “not applicable under the circumstances of [the] case.”

“It was proper for the jury to consider the actions of DuPont in determining whether DuPont was the cause in fact of Mr. Nye’s injuries,” read the court’s opinion. “However, it does not follow that it was also proper to instruct the jury that if DuPont was aware of any dangers in connection with the use of the products it purchased from North Brothers, North Brothers could not be held liable for failure to warn.”

Rwandan government announces big spending plan for asbestos removal

RWANDA – The Ministry of Infrastructure of Rwanda has announced that it will spend over Rwf 14bn ($23 million) on asbestos removal, making it the first country in Africa to ban and remove asbestos.
