Payout for Libby asbestos victims begins

LIBBY, Montana – Over 200 asbestos victims have received their portion of a $43 million settlement after becoming ill due to asbestos exposure from the former W.R. Grace & Co. vermiculite mine at Libby.

The settlement, which was approved in September 2011 by District Court in Helena, names a total of 1,128 asbestos victims. A resolution for another 600 claimants is close, but unfortunately, hundreds of other victims will have to wait until they can obtain a release from Medicare liens.

In cases where private insurance companies or the Grace Libby Medical Plan paid victims, no lien was placed. However, those with Medicare have to wait until they can obtain the green light to claim their settlement.

“Where Medicare has paid, it has a right by statute to recoup what it paid from settlements obtained by Libby asbestos disease patients,” said Jon Heberling, a Kalispell attorney and joint counsel for Libby claimant. “Since September when the state of Montana settlement was approved by the court, counsel for the Libby asbestos disease patients have worked closely with Medicare officials to fast track release of the Medicare liens.”

It is likely that the remaining claimants will be evaluated individually, but luckily, Medicare has agreed to an expedited review process.

Conoco Phillips Corp. appeals asbestos settlement decision

JACKSON — Conoco Phillips Corp. has appealed a jury decision that granted a multi-million dollar settlement to an oil drilling worker who claimed he became ill following asbestos exposure.

The Mississippi Supreme Court will hear Conoco’s arguments on Monday. The company has appealed a jury decision granting $15.2 million to a victim who claimed to have developed asbestosis as a result of working around asbestos.

The victim, Troy Lofton, filed the claims against CP Chem, a division of Conoco Phillips. He was diagnosed with asbestosis in 2004.

Lofton claimed that CP Chem knowingly shipped asbestos-laden products for 20 years that were used in the oil and gas well drilling industry in which he worked. As a result of the exposure to asbestos, Lofton now has to remain on oxygen 24 hours a day.

Conoco denies the claims and has filed an appeal. Arguments are scheduled for 1:30 p.m. in Jackson.
Asbestos is a mineral found in nature. It was once popularly used in construction materials due to its strength and durability. However, once it was discovered that asbestos contributed to several diseases, like asbestosis and mesothelioma, it was banned in the United States.

However, some companies continue to use asbestos illegally, exposing workers to the hazardous mineral and threatening their lives. Mesothelioma is perhaps the worst of all asbestos-related diseases because it is very hard to diagnose and treat.

Mesothelioma, a rare cancer that affects the lungs, heart and chest, can take up to 50 years to develop and its symptoms are often so mild that victims never end up seeking medical care. Even though some treatments might help patients who catch the cancer early on, there is currently no cure for mesothelioma.

If you are struggling with mesothelioma or have had a loved one pass away from the disease, you have a right to seek legal help. Turn to a leading mesothelioma lawyer immediately for assistance in filing a claim. As an asbestos victim, you may be entitled to millions of dollars in compensation, and mesothelioma attorneys ensure you receive every penny.

California Man Awarded $7.5 Million in Mesothelioma Settlement

LOS ANGELES, CA – A former Chico construction worker was compensated after developing mesothelioma from asbestos exposure.

Represented by mesothelioma attorneys Weitz & Luxenberg, the worker was able to collect $7.5 million after being exposed to asbestos-cement pipe for years.

Six companies were named in the lawsuit and each was found to have contributed to the worker’s illness. The 57-year-old man, who wishes to remain anonymous, was diagnosed with mesothelioma less than a year ago.

Mesothelioma is a rare cancer linked to the exposure of asbestos that affects the lungs, heart and chest cavities. It can take years to develop, making it extremely difficult to both diagnose and treat. Although current medical treatments like chemotherapy, radiation and surgery are available to help patients, there is currently no cure for mesothelioma.

According to Weitz & Luxenberg mesothelioma lawyer Daniel Wasserberg, Esq., “Our client was a construction worker who, in the 1970s and 1980s, helped install underground water and sewer lines. These pipes — 6 to 48 inches in diameter — were made of a concrete-asbestos composite material for strength but also for ease of fabrication. The defendants made, sold or delivered them.”

The plaintiff was responsible for cutting asbestos pipes, and was exposed to asbestos fibers which eventually caused his mesothelioma.

“Our client performed his work with a gasoline-operated saw,” said Brent Zadorozny, Esq., a Weitz & Luxenberg mesothelioma attorney. “The cuts generated an enormous amount of cement-asbestos dust, which flew in every direction from the saw’s whirring blades and engine exhaust blast. This veritable snowstorm of asbestos dust was at times so thick you couldn’t see the person standing three feet away from you.”

After years of being covered in asbestos dust, the plaintiff eventually developed mesothelioma.

Researchers discover link between asbestos exposure and mortality rate among textile workers

New research shows that textile workers in North Carolina and South Carolina who have been exposed to asbestos had a significantly greater rate of lung cancer, including mesothelioma.

Asbestos is a mineral that was once popularly used in construction materials and textiles but has been banned from several countries, including the United States, because it contributes to a number of illnesses, like the deadly mesothelioma.

Mesothelioma is a cancer that affects the lungs, heart and lining of the chest. It can take up to 50 years to develop, making it extremely difficult to both diagnose and treat. Although the cancer can be fought with chemotherapy, radiation and surgery, there is still no cure for mesothelioma.

In a study published in the January issue of the Occupational and Environmental Medicine journal, researchers monitored the progress of over 6,100 textile workers at four Carolina textile mills that previously manufactured asbestos. The researchers reported elevated death rates from lung cancer among the workers as opposed to the general population.

The researchers, based at the University of Nebraska, Duke University and the University of North Carolina, found that there was a strong correlation between the increased mortality rate from lung cancer and the exposure of asbestos.

The research further shows the dangers of breathing in asbestos fibers.

Resources to Connect with Mesothelioma Lawyers on Internet Threatened by SOPA

Mesothelioma is a rare cancer caused by the exposure of asbestos, a mineral found in nature. It affects the lungs, heart and chest cavities. Roughly 3,500 new cases of mesothelioma are discovered in the United States alone on a yearly basis, but many more go unnoticed. The disease is extremely difficult to both diagnose and treat for several reasons.

For one, mesothelioma can take up to 50 years to develop, making it hard for victims to associate their disease with their asbestos exposure. Second, symptoms don’t always develop, or are very mild, leading the victim to forsake medical care because they may just not think it’s necessary. Third, by the time symptoms even develop, it is usually too late to treat mesothelioma.

Although the cancer can be fought with chemotherapy, radiation or surgery, there is currently no cure for mesothelioma. Patients may see an improvement in their condition, but there is no way to completely get rid of it.

Fortunately, help is available to mesothelioma victims. Anyone who has been diagnosed with the disease or their loved ones should contact a mesothelioma lawyer immediately. As a victim, you and your loved ones may be entitled to thousands or even millions of dollars in money damages and medical care and your mesothelioma attorney will not rest until you do so.

Mesothelioma lawyers also fight to make sure those responsible for your asbestos exposure are held accountable for their negligence. Rest assured that your paralegal will not allow their actions to go unnoticed. Anyone guilty of exposing someone to asbestos without the proper safety gear or without notifying them of the presence of asbestos is liable to pay hefty fines and damages.

Finding a leading mesothelioma attorney is not easy, but with the help of the internet and sites like this, getting connected to a skilled paralegal is simple. Unfortunately, that convenience has been threatened by the SOPA act, a bill that aims to censor the internet. Millions of sites could be taken down for absolutely no legitimate reason, but you can do something to stand up for your rights to both use the internet and find a mesothelioma lawyer. Petition your state legislature and the federal government to stop SOPA and uphold your freedom to use the internet.
