Payout for Libby asbestos victims begins

LIBBY, Montana – Over 200 asbestos victims have received their portion of a $43 million settlement after becoming ill due to asbestos exposure from the former W.R. Grace & Co. vermiculite mine at Libby.

The settlement, which was approved in September 2011 by District Court in Helena, names a total of 1,128 asbestos victims. A resolution for another 600 claimants is close, but unfortunately, hundreds of other victims will have to wait until they can obtain a release from Medicare liens.

In cases where private insurance companies or the Grace Libby Medical Plan paid victims, no lien was placed. However, those with Medicare have to wait until they can obtain the green light to claim their settlement.

“Where Medicare has paid, it has a right by statute to recoup what it paid from settlements obtained by Libby asbestos disease patients,” said Jon Heberling, a Kalispell attorney and joint counsel for Libby claimant. “Since September when the state of Montana settlement was approved by the court, counsel for the Libby asbestos disease patients have worked closely with Medicare officials to fast track release of the Medicare liens.”

It is likely that the remaining claimants will be evaluated individually, but luckily, Medicare has agreed to an expedited review process.

Steve McQueen to be Honored at Asbestos Disease Awareness Organization Convention

Late actor Steve McQueen will be honored at the upcoming Asbestos Disease Awareness Organization convention this March.

Affordable Hazards Inc. wins bid to remove asbestos from Decorah High School

The School Board has ruled that asbestos will be removed from the Decorah High School roof areas by
Affordable Hazards Inc. over winter break.

Affordable Hazards Inc., had the lowest bid for the work, at $10,308 and has won all the asbestos removal bids for the high school’s renovation project.

The first task will be removing asbestos from the roof of the first-floor language arts classrooms, hallway, and two coaches’ offices. The first and second floor will be tackled this summer.

The school also plans to renovate the gymnasium so it can be ready in time for graduation. The gym will also be used for classes, which will be separated by a curtain. Demolition of the current gym will begin this sprint.

The three-phase project is expected to be completed in 2013.

Canadian Organization Calls for Ban on Asbestos

CANADA – A national environmental law organization has issued a statement urging for a ban on asbestos.

The Canadian Environmental Law Association is asking for support to ban asbestos in the US and Canada. The CELA endorsed a statement by the Asbestos Disease Awareness Organization and the Canadian Voices of Asbestos Victims, titled The North American Declaration, calling on Canadian Prime Minister Harper and US President Obama to help stop the production and exportation of the dangerous mineral.

“My father was exposed to asbestos while working as a labourer and electrician at the petro-chemical plants in Sarnia, Ontario. In 2008, he died from mesothelioma, just two months after his diagnosis, thirty to forty years after he was exposed,” said Stacy Cattran, Canadian Voices of Asbestos Victims Co-Founder. “Sarnia, like so many industrial towns, has suffered the loss of too many of her citizens to asbestos-related disease. After 130 years of mining asbestos, it is time for Canada to close the mines and transition the affected workers to other forms of industry. . . ”
