Company accused of negligence in asbestos case gets appeal thrown out

The family of a mesothelioma victim has just won their asbestos lawsuit and the company who filed a claim contesting the court’s ruling has lost their case.

On Wednesday, the Supreme Court ruled in favor of the family of Enid Costello, a former Ellesmere Port secretary that died from mesothelioma after being exposed to low-level asbestos.

Mesothelioma is a rare cancer associated to the exposure of the mineral asbestos. It affects the lungs, chest and heart cavities and can take up to 50 years to manifest.

Although there are many ground breaking treatments for mesothelioma, the sad reality is that by the time the cancer is diagnosed, it’s too late for patients to respond well to treatment. The window period to hope for improvement in the disease is a short 18 months after the cancer initially develops. Most patients don’t discover they have mesothelioma until it’s too late.

This ruling is expected to pave the way for similar cases of low level asbestos exposure that was previously believed to have no effect on a victim.

Enid Costello died in January 2006 at the age of 74. Her daughter, Karen Sienkiewicz, initially lost a county court claim she filed on her mother’s behalf but later won in the appeal court.

Costello was believed to have breathed in asbestos fibers while working as a secretary at Van Leer as well as while working at Greif (UK) Ltd, Oil Sites Road, Ellesmere Port during the time period of 1966 to 1984.

The claim was against her former employer and The Court of Appeal ruled in her family’s favor. However, Greif UK fought the ruling in the Supreme Court.

On Wednesday seven Supreme Court justices unanimously dismissed the appeals of Greif UK.
